Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets the rules for using Swungo, a creator-analytics tool operated by Swungo ("Swungo", "we", "us", "our") that surfaces publicly available short-form video (Instagram Reels) alongside virality metrics we independently compute from publicly available information. This AUP forms part of, and is incorporated by reference into, our Terms of Service; violating it is a breach of those Terms. Capitalized terms used but not defined here have the meaning given in the Terms of Service. If the AUP and the Terms of Service conflict, the Terms of Service govern. 1. Who this applies to

This AUP applies to everyone who accesses Swungo — free-tier visitors, paid subscribers, and anyone reaching our site, media, or servers through automated means. You must be old enough to form a binding contract in your jurisdiction (and at least 18 where that is required). By creating an account, viewing the dashboard, or otherwise using the Service, you agree to follow the rules below. If you use Swungo on behalf of an organization, you confirm you are authorized to bind it, and 'you' includes that organization.

2. What Swungo is for

Swungo is a research and inspiration tool for content creators. It helps you study which short-form video formats, hooks, and trending audio are performing, using our own computed estimates (such as view velocity and engagement) derived from publicly available information. You may use the dashboard, the metrics, and any content you download solely for your own internal creative research and reference, consistent with the limited, revocable, non-transferable, non-sublicensable license granted in our Terms of Service. Any other use — including commercial redistribution, resale, or public re-publication of what you find here — is prohibited by this AUP and falls outside that license.

3. Respect the paywall and your account

The free tier gives you the top 5 reels; the full Top-50 board, downloads, favorites, trending audio, and other paid features require an active subscription. You may not circumvent, disable, or work around the paywall, entitlement checks, rate limits, or any other access control — including tampering with subscription state, exploiting bugs to unlock paid features without paying, or using another person's paid session. One account per person. You are responsible for all activity under your account and for keeping your credentials secure; notify us promptly at [email protected] if you suspect unauthorized access.

4. No credential sharing or account resale

Your subscription is personal to you. Do not share, sell, rent, lease, or otherwise transfer your login credentials, session tokens, or account access to anyone else, and do not pool one paid account across multiple people to avoid buying separate subscriptions. Do not resell, sublicense, or provide Swungo access to third parties as if it were your own service. Sign-in patterns consistent with shared or resold access may be treated as a violation.

5. No scraping, bulk extraction, or automated harvesting

Do not scrape, crawl, spider, harvest, or use bots, scripts, headless browsers, or other automated means to extract data, media, or metrics from Swungo, and do not systematically download, cache, or index the board, the dashboard, or our computed metrics. Do not bypass, probe, or interfere with Cloudflare Turnstile, our rate limiting, or other bot-protection and security measures. Our virality metrics, rankings, selection, and compilation are Swungo's own work product and intellectual property; bulk-copying them for any purpose, including to build, train, or feed a competing product or dataset, is prohibited. Access the Service only through the interfaces we provide.

6. No circumventing our media controls

Swungo may cache a copy of a reel's video and thumbnail on private object storage (Cloudflare R2) and serve it only to authenticated users through short-lived, expiring (presigned) links that are not publicly indexable. Do not attempt to defeat, extend, share, republish, hotlink, or scrape these links; do not re-host, mirror, or make the underlying media publicly available; and do not build archives or libraries of downloaded media. Downloads are provided for your private study and reference only. These controls protect the creators whose work is shown and keep the media from being redistributed.

7. Respect third-party content and creators

The reels, thumbnails, captions, audio details, and related material shown in Swungo are publicly available third-party content that remains owned by the creators and rightsholders. Swungo is an independent tool and is not affiliated with, endorsed by, or sponsored by Instagram, Meta Platforms, Inc., or any creator or brand shown; all third-party names and marks belong to their respective owners. You must not republish downloaded reels as your own, remove or falsify attribution, or use anything obtained through Swungo in a way that infringes a creator's copyright, trademark, publicity, or privacy rights. You are solely responsible for your own use of any third-party content you access here. If you are a rightsholder who wants content removed, use our DMCA Policy and contact [email protected].

8. Do not misrepresent our metrics

Swungo's numbers are our own estimates derived from publicly available data and refreshed approximately every 48 hours; they are not official Instagram or Meta statistics and may be inaccurate, incomplete, or out of date. Do not present Swungo's metrics as official platform figures, as guaranteed outcomes, or as a promise that any content will perform, grow, or trend. Do not repackage our estimates as your own data product or attribute them to Instagram, Meta, or any creator. If you cite our figures, describe them accurately as Swungo's estimates.

9. No unlawful, harmful, or abusive use

Do not use Swungo to break the law or to harass, threaten, stalk, defame, or intimidate anyone, including creators shown on the board. Do not use the Service to infringe intellectual-property or privacy rights, to distribute malware, to engage in fraud or deceptive practices, or for any purpose unlawful in your jurisdiction. Do not use Swungo to compile unlawful profiles of individuals or for any activity that would expose Swungo, its operator, or its service providers to legal liability.

10. No interference with the Service or its infrastructure

Do not attempt to disrupt, degrade, overload, or gain unauthorized access to Swungo, its servers, its media storage, or other users' accounts. This includes denial-of-service attempts, excessive automated requests, penetration testing or vulnerability scanning without our prior written permission, and probing our systems or those of our infrastructure providers (including our EU/Germany hosting and storage). Do not reverse engineer, decompile, or disassemble our software except to the limited extent that restriction cannot be prohibited by applicable law. If you discover a security issue, report it responsibly and privately to [email protected] and give us a reasonable opportunity to address it before any public disclosure.

11. Payment integrity

Paid plans are billed through our payment provider and renew automatically until you cancel, as described in our Terms of Service and Refund & Cancellation Policy. Do not use fraudulent, stolen, or unauthorized payment methods, and do not abuse refunds, promotions, or free-tier access (for example, by creating multiple accounts to evade limits). If you have a billing concern, contact [email protected] first so we can try to resolve it directly; filing chargebacks in bad faith, or to reverse charges for access you actually used, is a violation of this AUP and may result in termination. Nothing in this section limits any payment-dispute or consumer rights you cannot waive under applicable law.

12. Consequences of violations

If you violate this AUP, we may — at our discretion and to the extent permitted by law — issue a warning, throttle or rate-limit your access, revoke or expire your presigned media links, suspend or terminate your account, disable specific features, cancel your subscription, and/or remove content. We may act without prior notice where a violation is serious, ongoing, unlawful, or poses a risk to Swungo, other users, creators, or our service providers. Termination for cause does not entitle you to a refund of fees already charged, except where a refund is required by applicable law or by our Refund & Cancellation Policy. Where appropriate, we may also stop re-hosting content associated with any source or creator subject to repeated valid infringement notices and terminate the accounts of repeat infringers, as described in our DMCA Policy.

13. Reporting and contact

To report a violation of this AUP, a security concern, or suspected abuse, contact [email protected]. For copyright and takedown matters, contact our designated agent at [email protected] and see our DMCA Policy. For privacy questions or data requests, contact [email protected]; our Privacy Policy explains what we collect and the service providers that process data on our behalf.

14. Changes, severability, and governing terms

We may update this Acceptable Use Policy from time to time to reflect changes in the Service, our practices, or the law. When we make material changes we will update the 'Effective date' above and, where appropriate, notify you by email or through the Service. Your continued use of Swungo after an update takes effect means you accept the revised Policy. If any part of this AUP is held unenforceable, the rest stays in effect. This AUP is governed by the same law and dispute-resolution terms as our Terms of Service.
