Swungo is a creator-analytics tool operated by Swungo. Swungo indexes publicly available information about short-form videos and computes its own independent virality metrics. So that signed-in subscribers can study a video alongside those metrics, Swungo may cache a copy of a reel's video and thumbnail on private object storage (hosted in the European Union) and serve it only to authenticated users through short-lived, non-public links. Swungo respects the rights of creators and other rightsholders. This policy explains how to ask Swungo to remove content, how Swungo responds, how to dispute a removal, and how Swungo handles repeat infringement. It applies to third-party creator content shown in the Service; how Swungo handles your own account data is described in the Privacy Policy, and your use of the Service is governed by the Terms of Service.
Swungo surfaces publicly available information about short-form videos (Instagram Reels) — such as view counts, captions, audio details, and thumbnails — and computes its own independent virality and engagement metrics. So that subscribers can study a video alongside those metrics, Swungo may cache a copy of the video and its thumbnail on private object storage (hosted in the European Union) and serve it only to authenticated users through short-lived, non-indexable links; this media is not made publicly available and is not search-indexable. Swungo claims no ownership of any third-party creator content: all rights in that content remain with the respective creators and rightsholders. Swungo's own rights are limited to its software, its database and compilation, its computed metrics, and its brand and presentation. Swungo is an independent tool and is not affiliated with, endorsed by, sponsored by, or connected to Instagram, Meta Platforms, Inc., or any of the creators, brands, audio, or platforms referenced in the dashboard; all third-party names and marks are the property of their respective owners and are used for identification and reference only.
Swungo takes copyright seriously and operates a voluntary notice-and-takedown program modeled on the U.S. Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. If you are a rightsholder (or someone authorized to act for one) and believe content shown on Swungo is used without authorization, you can ask Swungo to remove it using the process below, and Swungo will respond in good faith. Swungo prefers to keep attribution and control with the original creator: where appropriate, instead of showing a cached copy, Swungo may replace it with a link pointing to the original post on the source platform.
Swungo has designated an agent to receive notifications of claimed copyright infringement. Designated Agent: DMCA Agent, Swungo, reachable by email at [email protected] (the designated agent's full postal address is on file with the U.S. Copyright Office). To be effective, your notice should include substantially all of the following (see 17 U.S.C. § 512(c)(3)): (1) your physical or electronic signature; (2) identification of the copyrighted work you claim has been infringed (or, if multiple works are covered by a single notice, a representative list of them); (3) identification of the specific reel on Swungo that you claim is infringing, including its URL or reel ID so Swungo can locate it; (4) your name, mailing address, telephone number, and email address; (5) a statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law; and (6) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf. Incomplete notices may delay or prevent Swungo from acting, so please be sure to include the reel URL or ID.
On receiving a notice that substantially complies with the requirements above, Swungo will act expeditiously to remove or disable access to the identified reel video and thumbnail, or to replace it with a link to the original post on the source platform. Because the media is cached on private storage that is accessible only to authenticated users through short-lived links, removing it from Swungo makes that copy inaccessible to users. Where practical, Swungo will make a good-faith effort to record the action and, where applicable, notify the affected party. Swungo acts as promptly as it reasonably can; it describes its response as 'expeditious' rather than promising a fixed number of hours, because circumstances vary and Swungo does not want to commit to a timeframe it may not be able to meet in every case.
Swungo caches creator media so that its own virality metrics can be studied inside the dashboard. Where a valid notice is received, or otherwise at Swungo's discretion, Swungo may remove the cached copy entirely or replace it with a link pointing to the original post on the source platform, so that attribution and control remain with the original creator. Linking out rather than caching is often Swungo's preferred outcome, and rightsholders are welcome to request it at any time by writing to [email protected].
If you believe your material was removed or disabled as a result of mistake or misidentification, you may send a counter-notification to the Designated Agent at [email protected]. To be effective, it should contain substantially all of the following (see 17 U.S.C. § 512(g)(3)): (1) your physical or electronic signature; (2) identification of the material that was removed or disabled and the location on Swungo where it appeared before it was removed or disabled; (3) a statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification; and (4) your name, mailing address, and telephone number, together with a statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which the service provider may be found), and that you will accept service of process from the person who filed the original notice or that person's agent.
If Swungo receives a valid counter-notification, it will promptly forward a copy to the party who filed the original notice. Swungo may then restore the removed material, or cease disabling access to it, not less than ten (10) and not more than fourteen (14) business days after receiving your counter-notice — unless the Designated Agent first receives notice from the original complainant that it has filed a court action seeking a court order to restrain the allegedly infringing activity. Swungo follows this statutory waiting period to protect the interests of all parties and will not restore content early.
Swungo maintains a policy of terminating, in appropriate circumstances and at its discretion, the accounts of users who are the subject of repeated valid notices of infringement. Because Swungo curates its own board of content, Swungo may also, in appropriate circumstances, stop caching media associated with a source or creator that is the subject of repeated valid notices. This policy applies both to account holders and to the sources from which Swungo caches media. Termination of a paid account for repeat infringement does not by itself entitle the account holder to a refund; refunds and cancellations are governed by the Terms of Service and by the billing provider's policies.
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees. Copyright law also includes important limits and exceptions, such as fair use. Before submitting a notice or counter-notice, please consider whether the use may be permitted, and consult an attorney if you are unsure. Swungo may, at its discretion, decline to act on a notice or counter-notice that it reasonably believes is incomplete, invalid, or submitted in bad faith.
Swungo may keep a record of the notices and counter-notices it receives, including the information they contain, in order to operate this program, enforce its repeat-infringer policy, and comply with its legal obligations. As the DMCA requires in order to restore content, Swungo may forward a counter-notice — including your contact details — to the party who submitted the original notice. Personal data contained in these communications is handled in accordance with the Privacy Policy; the reels and creator media themselves are publicly sourced third-party content and are not the personal data of Swungo's account holders.

Swungo may update this DMCA / Copyright Policy from time to time and will post the revised version with an updated effective date. This policy is governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, consistent with the Terms of Service.
